King & Wood Mallesons review the amendments to the Hong Kong Arbitration Ordinance introducing third party funding for arbitrations and mediations in Hong Kong. This is one of the more comprehensive reviews I have seen and also draws comparisons with third party funding of arbitration in England and Wales to determine what practical lessons can be learned from the reform process in that jurisdiction. It is well worth a read given the potential impact of these changes to the arbitration landscape in Hong Kong.
