Astro prevails again against First Media (Lippo) in Hong Kong

Herbert Smith Freehills review the Hong Kong Court of Appeal’s decision in the Astro v Lippo dispute, where Lippo failed to obtain leave to appeal to the Court of Final Appeal. 


Leave was subsequently obtained directly from the Appeal Committee of the Court of Final Appeal who, in April 2018, the CFA handed down its decision upholding Lippo’s appeal, reversing the decisions at First Instance and the CA, thereby extending the time for Lippo to bring the application to resist enforcement of the Singapore awards in Hong Kong. The orders enforcing the awards were ultimately set aside in a hearing before Chan J in June 2018.
